2. Scope
These terms of use apply to the use of the Duetly app ("app", "service"). By registering or using the app, you agree to these terms.
Deviating terms only apply if the provider agrees to them in writing.
3. What the service provides
Duetly is an app for two people (a "couple") to find movies and shows together.
3.1 Features (current state)
- account with email and password, "Sign in with Apple" or "Sign in with Google"
- connect with a partner via an invite code
- swipe: like or skip titles, undo the last swipe
- joker: once per calendar month and person, turn the top title into a match without the partner's consent
- hand-picked recommendations ("Duetly pick") between the cards
- shared match list when you both like the same title, "What are we watching tonight?" random pick
- personal like list
- filters (including streaming region/services, cinema, movie/show, genre, rating, year, age rating for movies, international titles)
- match status (open / started / watched with stars and place / gave up with reason), "Watched" tab
- personal archive "Watched before" after a couple is dissolved
- remove a match from the shared list
- dissolve the couple, delete the account
- send feedback and support requests to the provider
- help texts in the app
3.2 What Duetly is not
- not a streaming player and no substitute for Netflix, Disney+, the cinema or similar
- no guarantee that a title is or stays available at a given service
- not a purchase, rental or subscription broker in the legal sense of a sales platform
- not a dating app
Film data and streaming information come largely from third parties (in particular TMDB) and may be incomplete, out of date or vary by region.
4. Registration and account
- For sync between two devices you need your own account.
- At registration you must accept the privacy policy and the terms of use (both viewable in the app).
- You must provide truthful information and keep your credentials secret.
- You are responsible for activity under your account, to the extent you are accountable for it.
- As a rule, one account per person is intended; misuse (spam accounts, automated mass usage) is prohibited.
- The app is aimed at users who have the necessary rights to use digital services. Parents and guardians are responsible for use by minors, to the extent provided by law.
The provider may suspend or delete accounts in the event of breaches of these terms.
5. Couple connection
- One person creates an invite code; the other joins with it.
- At most two people can be connected.
- Within the couple, shared matches and the shared match status become visible. Votes are loaded onto both devices for sync (match detection); "My likes" remains a separate list in the interface.
- Either side can dissolve the connection. The couple's shared cloud/sync data is then deleted; local likes on the device may remain. The titles you watched or gave up on together are copied into each person's own personal archive ("Watched before") — including the display name of the partner at that time (see privacy policy, section 3.6a).
- The joker is available to each person at most once per calendar month and only while a partner is connected. A match created by joker is visible to both and marked as a joker.
- You should only pass the code to the person you intend. Whoever holds the code can join the connection as long as the slot is free.
6. Content, swipes and match status
- Your likes, skips, removed matches and status entries are part of using the app and are processed as described in the privacy policy.
- Match status entries (watched, stars, place, gave up, reasons) are voluntary, but once you set them they apply to the couple and can be changed by your partner. Entries in your personal archive are changed by you alone.
- Feedback and support messages are additionally delivered by email to the provider's mailbox; your email address serves as the reply-to address.
- You may not use the app to transmit unlawful, harassing, insulting or abusive content (for example in feedback).
- The provider may use feedback, reasons for leaving and technical data in the course of operation, support and product improvement.
7. Permitted use / prohibitions
The following are prohibited in particular:
- hacking or overloading the app, or circumventing security mechanisms
- automated bots or scripts for mass rating or for extracting data
- identity theft or impersonating another person
- use contrary to applicable law
- passing credentials to third parties
8. Third-party content (TMDB and others)
This product uses the TMDB API but is not endorsed or certified by TMDB.
Movies, shows, posters, descriptions, ratings and streaming availability may come from The Movie Database (TMDB) and possibly other sources. Rights to this content lie with the respective rights holders.
Duetly:
- gives no warranty as to the accuracy or completeness of this information
- is not affiliated with the streaming services mentioned, unless expressly stated otherwise
- may store metadata about rated titles for the app to work (see privacy policy)
9. Availability and changes to the app
- The app is provided "as available". Maintenance, outages, API failures (e.g. Supabase, TMDB) or store updates may limit its use.
- The provider may change, extend, restrict or discontinue features — in particular during ongoing development and before a public store release.
- There is no claim to particular features unless separately agreed.
10. Costs
The current state of the app provides for no in-app subscription and no mandatory payment. Costs may arise for:
- your internet connection
- device or store costs, where applicable
- streaming subscriptions or cinema tickets outside of Duetly
If paid features are introduced later, they will be clearly marked and separately agreed.
11. Liability
- The provider is liable without limitation for intent and gross negligence, and under mandatory law (e.g. product liability, injury to life, body or health).
- In cases of slight negligence, the provider is liable only for breaches of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for this type of contract — to the extent permitted by law.
- No liability for decisions you make based on recommendations, matches or streaming information (for example whether a title really is available).
- No liability for third-party content and availability (TMDB, streaming services, device manufacturers, app stores).
Mandatory statutory rights of consumers remain unaffected.
12. Termination
- You can stop using the service at any time, dissolve the couple and delete your account in the app (Couple → Account → Delete account; see privacy policy). If you delete your account while connected, your partner first receives their personal archive of the titles you watched together. When deleting, the app asks for a short reason to help improve the product. Feedback sent earlier and the reason for leaving may remain with the provider until they are deleted on request.
- The provider may terminate access in the event of breaches or if the service is discontinued.
- After termination, backup and deletion periods may apply, to the extent legally permitted or required.
13. Privacy
Details on the processing of personal data are set out in the privacy policy: PRIVACY.md.
14. Copyright in the app
The app, its design, texts, logos and source code (except third-party open source) are protected by copyright. Using the app grants no right to reproduce, redistribute or reverse engineer it beyond what is permitted by law.
15. Changes to these terms
The provider may adapt these terms of use when features, the law or operations change. The current version applies as of the date stated above. Material changes should be pointed out in the app or on the publication page. If you object and continue to use the service after a new version takes effect, the provider reserves the right to terminate access — to the extent permitted by law. For consumers, the applicable information and objection rights apply.
16. Governing law / disputes
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions of another state conflict with this.
Consumers may turn to the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr. The provider is currently not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.
Place of jurisdiction for merchants / where permitted: Neuwied.
17. Severability
If any provision is invalid, the rest remains in force. The invalid provision is replaced by a valid arrangement that comes closest to its economic purpose — to the extent permitted by law.
18. Summary
- Duetly helps you find movies and shows together — it does not stream them itself.
- Everyone needs an account (email, Apple or Google); couples connect via a code.
- After a break-up, each person keeps their own "Watched before" list.
- Use it fairly, no abuse.
- Film data from TMDB may be wrong or incomplete.
